EB-1 Extraordinary Ability Visa

For individuals with extraordinary abilities in arts, sciences, education, business, or athletics.

Eligibility Criteria:

To qualify for an EB-1 visa, applicants must meet one of the following categories:

1. Extraordinary Ability
  • Demonstrate sustained national or international acclaim in fields such as sciences, arts, education, business, or athletics.
  • Evidence can include awards, published material, membership in associations, or contributions to the field.
2. Outstanding Professors and Researchers
  • At least three years of experience in teaching or research.
  • Recognized internationally as outstanding in as specific academic area.
  • Employment must be offered by a U.S. employer, either for a tenure-track teaching or comparable research position at a university or institution of higher education.
3. Multinational Executives and Managers
  • Must have been employed outside the U.S. in a managerial or executive capacity for at least one of the three preceding years by the overseas affiliate, parent, subsidiary, or branch of the U.S. employer.
  • The employment in the U.S. must be in a managerial or executive capacity.
Application Process:

Applying for an EB-1 visa requires:

1. Filing the Petition
  • The employer or the individual (for extraordinary ability) files Form l-140, petition for Alien Worker.
  • Supporting documentation must be provided to demonstrate eligibility.
2. Adjustment of Status or Consular Processing
  • If in the U.S. the applicant may file From l-485, Application to register permanent residence or adjust status.
  • If outside the U.S. the applicant will go through consular processing at a U.S. embassy or consulate.
3. Approval and Green Card Issuance:
  • Upon approval of the l-140 petition and successful completion of the adjustment of status or consular processing, the applicant will receive a green card, granting permanent residency.
