Must possess an advanced degree from the U.S. or foreign equivalent.

• The employer or the individual (for extraordinary ability) files Form l-140, petition for Alien Worker.
• Supporting documentation must be provided to demonstrate eligibility.

• If in the U.S. the applicant may file From l-485, Application to register permanent residence or adjust status.
• If outside the U.S. the applicant will go through consular processing at a U.S. embassy or consulate.

Upon approval of the l-140 petition and successful completion of the adjustment of status or consular processing, the applicant will receive a green card, granting permanent residency.

Unlike other employment-based visas, the EB-2 does not need a labor certification, expediting the process.

Grants immediate permanent residency to the applicant plus eligible family members.

Allows freedom to work in any field of study integral to U.S national interests or an employer working in the same field.

After 5 years of permanent residency, the applicant and their eligible family members can apply for U.S. citizenship.
