EB-3 Skilled / Unskilled Visa

The applicant must have no criminal record or be blacklisted for visa applications with the US government.

Applicant should be in good health with no contagious diseases and be physically able to work.

Applicant does not need any educational qualifications, English language test results or work experience. Applicant must be able to speak & understand English.

Applicant requires a sponsoring employer & employment position in the U.S. which have been approved by the Department of Labor.

The sponsoring employer files the Labor Certificate on behalf of the applicant. When approved it certifies that the applicant has paid job in the U.S.

• The employer or the individual (for extraordinary ability) files Form l-140, petition for Alien Worker.
• Supporting documentation must be provided to demonstrate eligibility.

• If in the U.S. the applicant may file From l-485, Application to register permanent residence or adjust status.
• If outside the U.S. the applicant will go through consular processing at a U.S. embassy or consulate.

• Upon approval of the l-140 petition and successful completion of the adjustment of status or consular processing, the applicant will receive a green card, granting permanent residency.

EB-3 provides for labor certification with a sponsoring employer offering paid employment for the applicant at a specific location in the U.S. of their choice.

Grants immediate permanent residency to the applicant plus eligible family members.

After 12 months working for the sponsoring employer, the applicant can live & work anywhere in the U.S. A dependent spouses’ Green Card permits them to live & work anywhere in the US upon arrival.

After 5 years of permanent residency, the applicant and their eligible family members can apply for U.S. citizenship.
